ROC is leading a campaign against the proposed Department of Labor Rule that tips should
become the property of employers rather than employees. This campaign is based in a larger
vision around worker rights and One Fair Wage legislation.
Day of Action Plans: Dec. 4th, 11th, and 18th
● December 4th: In 20 cities across the country, ROC worker members and staff
will be hand delivering letters to the DOL local offices. In addition, workers,
consumers, and employers will be livestreaming their stories and why they stand
against the DOL rule and for One Fair Wage.
● December 11th: In cities across the country there will be rallies in front of DOL
offices with chanting and demands by workers, consumers, and employers
● December 12th: A table hearing and press conference led by Saru Jayaraman,
President of ROC United
● December 18th: The largest of all 3 actions, in which workers, consumers, and
employers will rally against the proposed DOL rule in front of DOL offices. In
addition there we will be speakers in several of the rally locations.
Donald Trump’s Department of Labor (DOL), backed by the National Restaurant Association, is moving quickly to push a new rule that will make tips the property of restaurant owners rather than workers, i.e. steal tips from workers. Previously, the DOL stated that tips always belonged to employees. Now they say this was an error. The changes would allow employers to lower wages for all their workers, whether in the kitchen or in the dining room, since they would be able to hire all workers at minimum wage supplemented by tips. State restaurant associations are already telling their members that they will be able to do anything they want with the tips, as long as they make sure the minimum wage is met.
ROC United started a petition against the DOL tips rule where you can direct your list to submit their comments today and have gotten people all over the country, including Jane Fonda, talking about how inequitable this rule is.
This rule will bring the regulations in line with Donald Trump’s business practices, where he hires workers at $11 an hour or so without tips, and keeps the service charge, as high as 22%. You might as well call this the Mar-A-Lago rule. This change will also make sexual harassment and discrimination worse for workers. Customers decide how much they tip you, and now management will decide how much, if any, you get to keep. To make matters worse, the DOL is offering only a thirty hour comment period, the least permitted by law, during the winter holidays, when workers are the busiest and least able to comment on this rule affecting their livelihood. Workers will rally outside the DOL and other locations on Dec 11 and 18th to say No! to #TipTheft.
